    Terms & Conditions

    1. Acceptance of Terms

    By accessing or using the SiteMeUp website (https://sitemeup.co.za) and any services provided by SiteMeUp Online Marketing (Pty) Ltd ("SiteMeUp", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

    2. Services

    SiteMeUp provides a range of technology and marketing services, including but not limited to:

    • Technology assessments and infrastructure implementation
    • Custom web development
    • E-commerce technology solutions
    • WordPress security and managed operations
    • Web hosting (via Xneelo infrastructure)
    • Search engine optimisation (SEO) services

    The specific scope, deliverables, and timelines for any engagement will be outlined in a separate proposal or service agreement.

    3. User Accounts

    Certain features of our website require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

    4. Intellectual Property

    All content on the SiteMeUp website, including text, graphics, logos, icons, images, and software, is the property of SiteMeUp Online Marketing (Pty) Ltd or its content suppliers and is protected by South African and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

    Upon full payment for custom development or design work, ownership of the deliverables transfers to the client unless otherwise stated in the project agreement.

    5. Payment Terms

    • All prices are quoted in South African Rand (ZAR) unless otherwise stated.
    • Subscription payments are processed securely through PayFast.
    • Project-based work may require a deposit before commencement, as outlined in the relevant proposal.
    • Overdue invoices may attract interest at the prevailing legal rate.
    • SiteMeUp reserves the right to suspend services for accounts with outstanding payments.

    6. Service Availability

    We endeavour to maintain high availability of our website and hosted services. However, we do not guarantee uninterrupted access. Scheduled maintenance, infrastructure updates, or circumstances beyond our control may result in temporary downtime. Hosting uptime is subject to Xneelo's infrastructure guarantees.

    7. Limitation of Liability

    To the maximum extent permitted by South African law, SiteMeUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the event.

    8. Client Responsibilities

    • Provide accurate and complete information required for service delivery.
    • Grant necessary access to systems and platforms in a timely manner.
    • Review and approve deliverables within agreed timeframes.
    • Ensure that any content or materials provided to SiteMeUp do not infringe third-party rights.

    9. Termination

    Either party may terminate an ongoing service engagement by providing 30 days' written notice, unless otherwise specified in the service agreement. Upon termination, any outstanding fees remain payable. Subscription cancellations take effect at the end of the current billing cycle.

    10. Governing Law

    These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.

    11. Changes to These Terms

    We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
